PROPOSED ZONING ORDINANCE TEXT AMENDMENTS (A copy of the <br /> approved amendments are in the official ordinance book in the <br /> office of the Clerk to the Board. ) <br /> Planner Susan Smith presented for consideration of approval <br /> the Zoning Ordinance text amendments that were submitted to <br /> public hearing on February 24, 1986. <br /> The first set of amendments presented were to Article 4 Sections <br /> 4.2.8.b) 1, 4.2.11b) l, 4.2.2.21b) , 4.2.22b) 1 and 4.2.23b) l. These <br /> amendments relate specifically to the zoning district application <br /> criteria with regard to references to the joint planning area or to the <br /> specific townships and are listed on pages 83 and 84 of the agenda <br /> packet. The Planning Board recommends that these references be deleted <br /> and the proposed amendments to Article 4 approved. Susan Smith explained <br /> that in a number of zoning districts there is no mention made of Cheeks <br /> Township which was zoned in 1984. All the other townships were zoned in <br /> 1981. For example, the GC-4 district could not be applied to Cheeks <br /> Township under the current ordinance and, therefore, the full range of <br /> commercial uses was not permitted in that township. By deleting that <br /> restriction and incorporating Cheeks Township or by deleting all <br /> references to specific townships, it is clear that that district is <br /> applicable wherever the zoning ordinance is applicable or wherever the <br /> Land Use Plan establishes applicability by designating activity nodes. <br /> With regard to the Joint Planning Area, the approach to specify <br /> districts applicable to certain planned categories is being signifi <br /> cantly revised so that amendments will not be necessary in the Joint <br /> Planning process. <br /> Susan Smith clarified that these amendments would clearly <br /> allow the GC-4 district to be applied anywhere in a township <br /> where the Land Use Plan indicates that the full range of <br /> commercial uses are permitted. <br /> Motion was made by Commissioner Carey, seconded by Chair <br /> Willhoit to approve the Planning Board recommendation to amend <br /> Article 4, Sections 4.2.8.b) 1, 4.2.11b) l, 4.2.21b)l, <br /> 4.2.22b) l, and 4.2.23b) l. <br /> VOTE: UNANIMOUS. <br /> Susan Smith presented further amendments to Article 4, Secti <br /> ons 4.2.8.4, 4.2.9.4 and 4.2.10.6, which specify that <br /> limitations on acreages in the NC2 district and the LC1 <br /> district would not apply in the cases of Special Use Permits <br /> or Existing Commercial-5 zoning districts. The Planning Board <br /> has recommended that these amendments not be approved. <br /> Barry Jacobs indicated the Planning Board recommended denial <br /> because they felt expansion of the activity nodes would be encouraged by <br /> discounting the acreages associated with uses permitted under special <br /> use permits and Existing Commercial-V zoning within the nodes. While it <br /> is important to recognize that these uses could occur in those areas, <br /> the Board felt there should be limitations on the scale of the nodes as <br /> previously defined in the Land Use Plan. <br /> After extensive discussion motion was made by Chair Willhoit, <br /> seconded by Commissioner Marshall to approve the amendments to <br /> Article 4, Section 4.2.8.4, 4.2.9.4 and 4.2.10.6 with the <br />
