Fair market value <br /> shall be determined by an appraisal , done at the <br /> expense of the subdivider , by a qualified individual , <br /> subject to the terms and conditions of the next <br /> paragraph in the event . the Board of County <br /> Commissioners notifies the subdivider that it does not <br /> agree with the .appraisal provided by the subdivider. <br /> All payments received by the County pursuant to this <br /> section shall be placed in a Park and Recreation <br /> Improvement Fund to be established by the Board of <br /> Commissioners. Such funds shall be used only for the <br /> acquisition or development of park, recreation or open <br /> space sites which will serve the residents of the <br /> proposed subdivision and for which the payments are <br /> made. All payments in lieu of provision or dedication <br /> shall be due prior to the approval of the final plat <br /> of the subdivision or any phase thereof. <br /> In the case of disagreement between the County and the <br /> subdivider as to fair market value, such determination <br /> shall be made by a special appraisal committee made up <br /> of one (1) professional appraiser appointed by the <br /> subdivider, one (1) professional appraiser appointed <br /> by the Board of Commissioners, and one (1) <br /> professional appraiser agreed upon by the two (2) <br /> appraisers appointed by the subdivider and the Board <br /> of Commissioners. The committee shall view the land <br /> and hear the contentions of both the County and the <br /> developer. The findings of the committee shall be by <br /> majority vote and shall be certified to the Board of <br /> Commissioners within thirty (30) days of the date of <br /> appointment of the third member of the committee. The <br /> costs of the • committee shall be borne by the <br /> subdivider. <br />
