STATE OF NORTH CAROLINA . <br /> RELEASE OF PORTION OF. <br /> COUNTY OF ORANGE RIGHT-OF-WAY PREVIOUSLY GRANTED <br /> THIS AGREEMENT is dated the WA , day of Aut.r ( , 1986, and is by <br /> and between COUNTY OF ORANGE, a body. politic and corporate, hereinafter known <br /> as Grantor, and JESSIE COUNCIL, of Orange County, North Carolina, hereinafter - <br /> known as Grantee, whose permanent mailing address is . <br /> . <br /> W I' TN• E S SBTH: <br /> THAT WHEREAS, Grantee' has previously conveyed to Grantor, a certain right- <br /> of-way for the paving of the streets in the Councilville area; and <br /> WHEREAS, the location of the streets has . been changed such that the <br /> previously granted right-of-way is no .longer required for the paving of the <br /> streets; and <br /> WHEREAS, Grantor desires to. reconvey to Grantee in exchange for new <br /> rights-of-way to be conveyed by Grantee to Grantor by separate conveyance all <br /> that portion of the original right-of-way grant as does not lie within the <br /> right-of-way of the streets as now proposed to be built. <br /> NOW, THEREFORE, in consideration of the premises and TEN DOLLARS ($10.00) <br /> and other good and valuable consideration, the receipt of which is hereby <br /> acknowledged by the Grantor, the Grantor does hereby quitclaim and, release, and <br /> by these presents has quitclaimed and released, unto the Grantee, his heirs, <br /> successors, and assigns, the previously conveyed rights-of-way which do not lie <br /> within the 50-foot wide right-of-way of STREET B as shown on the attached <br /> Exhibit A. <br /> TO HAVE AND TO HOLD said land, with all the appurtenances thereunto <br /> belonging, or in any wise appertaining, unto the Grantee, his heirs and/or <br /> successors and assigns forever, free and clear of the claims of the Grantor <br /> and/or its successors and assigns. <br /> When reference is made to the Grantor or Grantee, the singular shall include <br /> the plural and the masculine shall include the feminine or the neuter. <br /> IN WITNESS WHEREOF, The Grantor has caused this instrument to be signed in <br /> its corporate name by its duly authorized officers and its seal to be hereunto <br /> affixed by authority of its County Commissioners, the day and year first above <br /> mri rran_ <br />
