DAVIS - REZONING <br /> The purpose of this agenda item is to receive the <br /> Planning Board recommendation on a proposed <br /> rezoning request submitted by Vernon P . Davis. <br /> Vernon P . Davis is requesting a rezoning for 1 acre <br /> located on the south side of NC Highway 54, east of <br /> the Gulf Station/Store and west of Larry 's <br /> Alignment Shop in Bingham Township . <br /> This site has direct access onto NC Highway 54 . <br /> This road is designated as an arterial in the Land <br /> Use Plan . Fire protection for the property would <br /> be provided by the Orange Grove Rural Fire <br /> District . Law enforcement protection would be <br /> provided by the Orange County Sheriff's Department. <br /> The property is known as part of Lot 8 of Tax Map <br /> 30B for Bingham Township . The parcel contains 1 <br /> acre or 43 ,419 square feet . <br /> The area is characterized by the following uses: <br /> Triple C Auto Parts - zoned NC-2 , Gulf Station - <br /> zoned NC-2 , Larry 's Alignment - zoned NC-2 , Ray's <br /> Garage - zoned EC-5 , Old School - zoned NC-2 . <br /> The property is designated as Agricultural <br /> Residential and as Rural Community Activity Node <br /> in the Orange County Land Use Plan . <br /> The present zoning classification of the property <br /> is A-R (Agricultural-Residential) . The applicant <br /> is requesting the lot be rezoned to NC-2 <br /> (Neighborhood Commercial-2) <br /> Approval of the request would allow for limited <br /> commercial development use at this location. The <br /> property is presently located in an area designated <br /> as Rural Community Transition Activity Node in the <br /> Land Use Plan with property immediately to the east <br /> and west zoned A-R . <br /> The Planning Staff recommends approval of the <br /> general rezoning request . <br /> MOTION: Shanklin moved approval . Seconded by Pearson. <br /> Kizer inquired why the area size was given <br /> exclusive of right-of-way . Smith responded it was <br /> for information only . Kizer felt the figures were <br /> juggled just to fit the request . Collins responded <br /> he had asked for area exclusive of right-of-way to <br />
