SEDIMENTATION Telephone Numbers <br /> CONTROL COMMISSION Hillsborough - 732-8181 <br /> EXCERPTS FROM EROSION CONTROL Durham - 688-7331 EXT. 351 <br /> ORDINANCE Mebane - 227-2031 <br /> Chapel Hill - 968-4501 <br /> PURPOSE: To consider and act upon proposed revisions to the Orange <br /> County Soil Erosion and Sedimentation Control Ordinance . <br /> NEED: On July 24 , i985 the North Carolina Sedimentation Control <br /> Commission notified . the Commissioners of required revisions to <br /> bring the local Ordinance into compliance with changes to the <br /> State' s Model Soil Erosion and Sedimentation Control Ordinance . <br /> The Erosion Control Division of the Planning Department pre- <br /> pared these revisions and sent copies to the State for their <br /> review and comment . The approval process (Planning Board re- <br /> view, public hearing, Board of Commissioners approval ) <br /> proceeded with no negative comment from the Sedimentation <br /> Control Commission. Upon review of the approved amendments , <br /> ( sent on December 6 , 1986) the Commission staff requested <br /> (February 10 , 1986) that other revisions be made to the <br /> Ordinance in addition to those changes requested in July, 1985. <br /> The requested changes include correction of typographical <br /> errors , and the addition or substitution of words and phases to <br /> make the Ordinance consistent with defined terms . A public <br /> hearing for changes to the Erosion Control Ordinance is not re- <br /> quired by statute , but , as a matter of policy has been held <br /> whenever substantial changes are to be made to the Ordinance. <br /> The County Attorney will review the proposed amendments and <br /> render a decision at the meeting regarding the necessity of a <br /> public hearing. <br /> IMPACT: The proposed revisions to the Erosion Control Ordinance will <br /> have no effect on the administration or enforcement of the <br /> Ordinance or affect land disturbances that are not now covered <br /> by the Ordinance. These changes will make the Ordinance <br /> technically correct and address legal points important in <br /> enforcement of the Ordinance . <br /> RECOMMENDATION: Consideration and approval of the proposed revisions subject <br /> to the recommendation of the County Attorney._ <br />
