00032 <br /> EXHIBIT A <br /> B. All that certain parcel of land situate in Cheek' s <br /> .Township, Orange County, North Carolina, and being more <br /> particularly described as Tract 2A on a plat prepared by <br /> Alois Callemyn, Registered Land Surveyor for Orange County <br /> Investors, a South Carolina General Partnership, dated <br /> January 18, 1985 reference being hereby made to said plat for <br /> a more particular description of the property herein <br /> conveyed. <br /> C( 1 ) . The property herein described is a portion of 137. 08 <br /> acres which has been designated by Orange County Planners as <br /> the commercial transition area. The project was commenced <br /> approximately two (2) .years ago with the construction of the <br /> buildings on or about September 1 , 1984. At all times prior <br /> to the beginning of construction, the applicants were <br /> informed that this property was designated as commercial by <br /> the land use plan and was suitable for commercial purposes by <br /> numerous members of the community along with the members of <br /> the planning department. We attended the planning meeting of <br /> the County Council in March of 1984 at which time we talked <br /> to members of the County Council concerning the zoning of our <br /> particular parcel . At that time all the maps along with the <br /> members at the meeting from the planning department indicated <br /> all our property would be designated comercial when the <br /> zoning ordinance was enacted. On March 30, 1954, letters <br /> were submitted to Orange County Planning Department and Board <br /> of Commissioners asking that this property be designated <br /> commercial when the legislation was enacted for zoning. It <br /> has been sighted that because of failure to advertise <br /> properly it could not be rezoned when the original plan was <br /> adopted. <br /> C (2) . 'The subject property i s adjoined on the northern side <br /> by Interstate 85 and on the western side by Duckhorn Road. <br /> These two roads are major arteries in Orange County and would <br /> prevent any substantial residential construction on the <br /> subject. property. It is adjoined also on the West by a <br /> commercial establishment known as the t?uckharn Fina Service <br /> Station. It has been recognized as prime commercial property <br /> not only by the applicants, but by Orange County Planning and <br /> Development Boards who recognize the need for commercial <br /> development along the 1--•85 corridor where good access can be <br /> acquired without unreasonably increasing the traffic flows on <br /> the secondary arteries. <br /> C (3) .
