A2ulig$bilit. i <br /> In every subdivision, school sites may be reserved in <br /> accordance with the adopted Land_ u_UUQn for Orange <br /> County. For authorization to reserve school sites to <br /> be effective, the Board of Commissioners , prior to the <br /> adoption of the Land__E .a__Plan or any amendment <br /> thereto, shall have jointly determined with the Board <br /> of Education having jurisdiction over the area, the <br /> specific location, size and suitability of each school <br /> site to be reserved. All sites so designated shall <br /> appear in the LansLag_Elan. <br /> 1V-B-7-a-2 . 4athQS1_Qt_ggsgLY&tiQn <br /> Whenever a subdivision which includes part or all of a <br /> school site to be reserved is submitted for approval , <br /> the Planning Board and the Board of Commissioners <br /> shall immediately notify the Board of Education having <br /> jurisdiction over the area. The Board of Education <br /> shall promptly decide whether it wishes the site to be <br /> reserved and shall notify the Planning Board and Board <br /> of Commissioners of its decision. If the Board of <br /> Education does not wish the site to be reserved, no <br /> site may be reserved. If the Board of Education does <br /> wish the site to be reserved, the subdivision may not <br /> be approved without the reservation and without the <br /> school site being designated on the subdivision plat <br /> as such. <br /> The Board of Education must acquire the school site <br /> either by purchase or by exercise of the power of <br /> eminent domain within eighteen (18) months after the <br /> date the site is reserved. If the Board of Education <br /> has not purchased the site or begun proceedings to <br /> condemn the site within the eighteen ( 18) months , the <br /> subdivider may treat the land as freed of the <br /> reservation. <br />
