V. HUD 'CONTRACT CLAUSES <br /> A. Conflict of Interest <br /> No member, officer, or employee of the ENGINEER shall have any <br /> financial interest, direct or indirect, in any contract or sub- <br /> contract, or the proceeds thereof, for work to be performed in <br /> connection with the program assisted under this agreement. <br /> Immediate family members of said members, officers, employees, <br /> and Officials are similarly barred from having any financial <br /> interest in the program. <br /> B. Nondiscrimination <br /> 1. The ENGINEER shall not on the grounds of race, color, national <br /> origin or sex, exclude from participation in, deny the benefits <br /> of, or subject to discrimination, any person in the United States <br /> in connection with the work to be performed under this Agreement. <br /> 2. The ENGINEER shall not on the basis of age, exclude from <br /> participation in, deny the benefits of, or otherwise subject to <br /> discrimination any qualified person in connection with the work to <br /> be performed under this Agreement. <br /> 3. The ENGINNER shall not, on the basis of handicap, exclude from <br /> participation in, deny the benefits of, or otherwise subject to <br /> discrimination any qualified person in connection with the work to <br /> performed under this Agreement. <br /> C. Executive Order 11246 shall be adhered to by the ENGINEER. Executive <br /> Order 11246 is hereby incorporated into this Agreement by reference, <br /> and is attached as Exhibit 1 to this contract. In determining <br /> compliance with Executive Order 11246, the word "ENGINEER" shall be <br /> substituted for the word "contractor" in Exhibit 1. <br /> D. "Section 3" of the Housing and Urban Development Act of 1968, as <br /> amended, 12 U.S.G. 1701a, shall be adhered to by the ENGINEER, is <br /> hereby incorporated into this Agreement by reference, and is <br /> attached as Exhibit 2 to this contract. In determining compliance <br /> with 1,"Section 3" of the Act the word "ENGINEER" shall be sub- <br /> stituted for the word "contractor" in Exhibit 2. <br /> E. Access to Records, and Record Retainage <br /> The ENGINEER shall maintain all project records and documents <br /> during the operation of the project and for a period of three <br /> yearsl,following close out in compliance with 15 NCAC 13L Rule .0911, <br /> Recordkeeping. <br /> The North Carolina Department of Natural Resources and Community <br /> Development, the North Carolina Department of the Treasurer, U. S. <br /> Department of Housing and Urban Development, the Comptroller General <br /> of the United States, or any of their duly authorized representatives, <br /> shall, have access to any books, documents, papers and records of <br /> the Administering Agency which are pertinent to the execution of <br /> this Agreement, for the purpose of making audits, examinations, <br /> exerpts and transcriptions in compliance with the above Rule. <br />
