ITEMS FOR DECISION <br /> 10. P & S SPORTING GOODS, INC. (A copy of the legal opinion from <br /> Attorney Geoffrey Gledhill is in the permanent agenda file) . <br /> Attorney Geoff Gledhill summarized the main points in his <br /> letter to the Commissioners. He listed four recommendations for <br /> consideration by the Board: <br /> (1) Consider the zoning change application without regard to <br /> the intended use of the applicant. <br /> (2) Consider the zoning change application in the context of <br /> there already being 8.5 acres of commercial property in <br /> this activity node with the zoning ordinance permitting, <br /> normally, a maximum of 10 acres. <br /> (3) Direct the staff to correct the improper zoning <br /> designations in this node and any other similar errors <br /> that may exist throughout the County. <br /> (4) Direct the staff to develop a new use which includes the <br /> kind of business in question here and which has minimal <br /> off-site impacts. This new use should preferably be a <br /> special use with the application criteria focused on <br /> buffers, screening, site plan review, traffic management <br /> and the like. Included in this staff review should be a <br /> recommendation concerning where this new use/special use <br /> would be permitted. The kind of use in question <br /> certainly is not a "Mom and Pop" operation. However, its <br /> impacts on the neighborhood or area where it is located <br /> are minimal because its activity is confined within a <br /> structure with little comings and goings to and from that <br /> structure. For these reasons this use may be one <br /> permitted more pervasively than any other use that's not <br /> locally focused. This should be addressed by the <br />
