Staff initiated Lega <br /> proceedings and was prepared to go to court when th = <br /> defendant 's attorney requested a hearing before the judge t. <br /> determine the County 's right to enforce such provisions . Th <br /> contention of the defendant 's attorney was that Steitz <br /> regulations preempted the County 's authority . <br /> The judge ruled that the County could regulate junked and/or <br /> abadoned vehicles , but indicated that ordinance revisions were <br /> necessary to insure the constitutionality of the provisions . <br /> The County Attorney has prepared proposed amendments which <br /> address the judge ' s concerns . <br /> IMPACT: Amendment of the Zoning Ordinance would allow staff to roce <br /> with enforcement action . P ed <br /> RECOMMENDATION : Approval of the ordinance amendments . <br />
