SUMMARY OF ORANGE COUNTY PLANNING BOARD ACTION <br /> Subject: Appeal of Staff Decision - Minor Subdivision of the Doris Lee Property <br /> Recommendation: Reverse the staff decision, thereby freeing the applicant of <br /> the proposed staff requirement to provide a 50' right-of-way as part of the <br /> minor subdivision. <br /> Vote: 81 - 2 Meeting Date: December 16. 1985 <br /> Issues Raised: <br /> 1. The applicant has the road fronaye necessary for the minor subdiviOpp. If <br /> the 50' right-of-way is to be required, how would the applicant be compensated <br /> for this property? <br /> 2. There is no specified collector road system in this area, so it is not known <br /> whether access to the large tracts behind the proposed subdivision would need to <br /> exit at the Site of the Drowsed right-of-way. On the other hand, since there is <br /> an existing!travelway in this vicinity, it would seem logical to plan the road for <br /> this location. in their diicussiojj of issue Land 2. the Board gilled into <br /> question the whole system of specifying stub-outs and proposed rights-of-way <br /> in the absence of a designated road system. while recoonizinq that the public <br /> etim outweigh riv r er -ms in instances <br /> 3. The Board questioned whether Blunderbuss Lane had legal status as an <br /> existing right-of-way, and therefore whether the twenty foot right-of-way <br /> could be used along with thirty feet from the applicant's property to achieve a <br /> SO' right-of-way. However. the status of Blunderbuss Lane is in question_ <br /> According to the applicant's representative. the Lane's status is"a matter for <br /> the courts to decide." <br /> Explanation of Dissenting Votes: <br /> 1 <br /> Those who dissented believed that it was necessary to provide future access at <br /> the proposed location to the large tracts located behind the minor subdivision <br /> Other Information and/or Citations from County Regulations: <br /> Jhe Chair stated that this discussion revealed a need to evaluate the County's <br /> olio. on stub-outs and ro osed dedications of ri hts-of-w which r uire <br /> property owners near the road to provide access to parcels of land located <br /> behind them without any compensation, and perhaps against their will even if <br /> compensation were offered.
