G.S. 126-5(a) is amended to become G.S. <br /> 7 126-5 (a) (1) . <br /> 8 Sec. 2. G.S. 126-5 (a) is further amended by adding a <br /> 9 new subsection to read: <br /> 10 " (2) The executive heads of local government agencies and the <br /> 11 positions reporting directly to them which are primarily <br /> 12 responsible for both substantive program policy determination and <br /> 13 its public advocacy, confidential assistants to these positions, <br /> 14 and attorneys serving as legal counsel may be exempted from <br /> 15 coverage under provisions of this Chapter, except_frrZIcIe 6, <br /> 16 when so requested jointly by aboards,--E- Llity commissioners and <br /> 17 the program board concerned, such request to be made in <br /> 18 accordance with rules established by the State Personnel <br /> IC' <br /> 19 COMMiSSiOD.
