me <br /> 0!) u <br /> - 2 - <br /> Carrboro to review projects in areas subject to joint planning, as well as agree- <br /> ments authorizing the Towns of Chapel Hill and Carrboro to enforce the developm.5, <br /> standards through site inspections should that be desired by mutual consent. <br /> It is further agreed that all of the Governmental Units who are parties to <br /> this Agreement shall be notified in writing prior to the amendment to or modifica- <br /> tion of ady development standard that would apply in an Orange County-Chapel Hill- <br /> Carrboro-Joint-Planning Area by the party considering such action. <br /> It is further agreed that joint review of development proposals in the Joint <br /> Planning Areas will occur initially at the staff level, with each Governmental Unit <br /> deciding on the subsequent role of its governing body, planning board, board of ad- <br /> justment, planning department and other staff. It is agreed that the Governmental <br /> Units responsible for a final decision on a project within its authority and subject <br /> to its decision will allow sufficient time for the other interested parties to con- <br /> duct their reviews prior.to action on the request. <br /> Further, it is agreed that the Committee on Joint Planning is authorized to <br /> continue its work so as to include, but not be limited to, periodic review and <br /> evaluation of progress on Joint Planning between and among the Governmental Units., <br /> and to further recommend definitions of joint standards for development proposals, <br /> to make recommendations as to establishment of an urban services area for the ext7:7- <br /> sion of water and sewer facilities, and to make such other recommendations as it.ay 1,1 <br /> appropriate to encourage infill development. <br /> For its part, OWASA agrees that, to the extent of its legal authority um <br /> theprov-isions of Chapter 162A of the General Statutes of North Carolina, and i <br /> proper exercise of its public and essential governmental purposes to furnish <br /> and sewer services in its service area, to cooperate with the Governmental Uni;::3 <br /> furnishing and extending its water and sewer services, and advising the Covert. <br /> Units on standards required for service development so that those standards <br /> incorporated across extraterritorial districts. <br /> It is understood, however, that in cooperating with one another in the ,7tris <br /> and to the extent herein referred to, each of the parties hereto retains at all L'!:,.0 <br /> the authority to make its own decisions and to carry out its own policies conceap, <br /> its operations and the extension of its services; and this cooperation agreement <br /> shall not be interpreted as implying a delegation or abridgement of authority or <br /> sponsibility vested in the respective parties by law, notwithstanding any languac.1 <br /> contained herein or in any planning reports or other documents which might seem <br /> the contrary. <br /> IN TESTIMONY WHEREOF, each of the parties hereto has caused this Agreement tc <br /> be executed in quadruplicate originals by their properly authorized officers and <br /> the/1 official seals to be affixed, all as of the day and year first above written- <br /> t <br />
