0:- Rev. 3/3/81 <br /> AGENDA ATTACHMENT 10 <br /> NORTH CAROLINA <br /> ORANGE COUNTY AGREEMENT <br /> This AGREEMENT, made and entered into this the day <br /> of , 1981, by, between and among the COUNTY <br /> OF ORANGE, the TOWN OF CHAPEL HILL, and the TOWN OF CARRBORO, <br /> hereinafter referred to as "Governmental Units", and ORANGE WATER <br /> AND SEWER AUTHORITY, hereinafter referred to as "OWASA"; <br /> WITNESSET <br /> That for and in consideration of the public benefits expected <br /> to flow from the cooperative efforts of the Governmental Units <br /> between and among themselves from the establishment of coordinated <br /> and comprehensive planning within their respective areas of public <br /> concern, said Governmental Units do hereby mutually agree as follows: <br /> Section 1. PURPOSE OF THE AGREEMENT. The purpose of this <br /> Agreement is to establish a method whereby coordinated and <br /> comprehensive planning may be provided for an Orange County-Chapel <br /> Hill-Carrboro Joint Planning Area as delineated on the adopted <br /> Orange County Land Use Plan Map. <br /> Section 2. CREATION OF JOINT PLANNING PROCESS. The <br /> Governmental Units hereby establish a joint planning process for <br /> the review of land development in the Orange County-Chapel Hill- <br /> Carrboro Joint Planning Area. <br /> Section 3. DURATION. This Agreement shall be effective upon <br /> its execution by the Governmental Units and shall continue thereafter <br /> until the day of , 19 , or until <br /> all but one of the Governmental Units have withdrawn. At the <br /> termination date specified, this Agreement may be renewed for an <br /> additional specified period of time, upon mutual agreement of all <br /> the Governmental Units. <br /> Section 4. MUTUAL PROMISES AND CONCERNS. It is agreed that <br /> a mutual policy of good will is essential to this process. It is <br /> further agreed that the process will be based upon Mutual adoption <br /> of land use plan and development standards by the Governmental Units <br /> for areas to be urbanized within a ten and twenty year period and <br /> those Joint Planning Areas that will remain rural during the next <br /> twenty year period (Rural Buffer) . <br /> It is further agreed that Orange County will adept and <br /> apply development standards in the Transition Areas (the ten and <br /> twenty year areas) as delineated on the adopted Orange County Land <br /> Use Plan Map which meet or exceed Carrboro and Chapel Hill development <br /> standards. These development standards will be defined and mutually <br /> adopted in a subsequent agreement. Upon the adoption of such regulation <br /> additional agreements will be adopted authorizing Orange County and <br />
