G.S. 115-52 is rewritten to read: <br /> 10 , "§115-52.i purchase of equipment and supplies.--(a) A <br /> 11 local board of education shall purchase or exchange all sup <br /> 12 materials and equipment in accordance with the provisions o <br /> 13 Article 8 of Chapter 143 of the General Statutes and rules <br /> 14 procedure S adopted by the board. <br /> 15 (b) A local, board of education may purchase or exchanc <br /> 16 supplies, equipment and materials through the services of <br /> 17 the Department of Administration pursuant to G.S. 143-49 (6) . <br /> 18 (c) Title to instructional supplies, office supplies, <br /> 19 fuel and janitorial supplies, enumerated in the current expE <br /> 20 fund budget and purchased out of State funds, shall be taker <br /> 21 in the name of the local board of education which shall be <br /> 22 responsible for their custody and replacement: Provided, th <br /> 23 no contracts shall be made by the board for purchases unless <br /> 24 provision has been made in the budget of such unit to provid <br /> 25 payment therefor , or unless surplus funds are on hand to pay <br /> 26 for same , and in order to protect the State purchase contrac <br /> 27 it is hereby illade the mandatory duty upon the part of the loi <br /> 28 board of eduction to pay for such ournhA <br />
