A person applying for rezoning of a tract of land, <br /> where planned development and special use districts are <br /> authorized by ordinance, may elect to request general use <br /> district zoning for said tract, or may elect to request <br /> planned development or special use district zoning for said <br /> tract. <br /> If the applicant elects to apply for general use <br /> district zoning, the Board of Commissioners may not consider <br /> the intended use in determining whether to approve or <br /> disapprove the application, but shall consider the full range <br /> of uses permitted within the requested general use district. <br /> If the application is approved, the rezoned property may be <br /> used for any of the uses permitted in the applicable general <br /> use district. If the applicant elects to apply for planned <br /> development or special use district zoning, the application <br /> must specify the actual use intended for the property <br /> specified in the application, and the intended use must be <br /> one permitted in the corresponding general use district. If <br /> the application is for planned development or special use <br /> district zoning the Board of Commissioners must approve or <br /> disapprove the application on the basis of the specific use <br /> requested. If the application is approved, the Board of <br /> Commissioners shall rezone the property to the applicable <br /> district and in the case of a special use district <br /> application issue a special use permit authorizing the <br /> requested use.
