They found the ordinance satisfactory with <br /> one exception. They requested that within 60 days, the County submit to <br /> them a revision to Section 4.2 of the ordinance deleting subsection 4.2(e). <br /> This change will remove from the, list of uses permitted by right in flood <br /> ways streets, bridges and certain other similar uses. Location of these <br /> uses in floodways henceforth would require the issuance of a variance by the <br /> Board of Adjustment. This change will bring the ordinance into compliance <br /> with State legislation and Federal regulations pertaining to floodways. <br /> Planning staff recommends this amendment. <br /> The Planning Board at its February 10, 1981 meeting considered the following <br /> two questions regarding regulation of flood hazard areas; <br /> (a) appropriate regulations for flood hazard areas. <br /> (b) areas to which regulations should apply. <br /> Flood maps provided to the County under the National Flood Insurance Program <br /> delineate two regions for regulation within areas subject to flooding. <br /> Floodways are the stream channel and adjoining lands necessary to discharge <br /> the 100-year flood waters. Federal program requirements allow very limited <br /> use of the floodway. This area must be kept free of structures and other <br /> uses which would restrict the discharge of flood waters. The floodway <br /> fringe is land not in the floodway but still subject to flooding. <br /> Federal program requirements allow structures in the floodway fringe if they <br /> are elevated above the 100-year flood level or flood-proofed. <br /> The Planning Board has recommended that the more stringent regulations for <br /> floodways apply to the floodway fringe as well. <br />
