The County Sub- division Ordinance did not go int0.effect in five townships, until 1978. This leaves a period of several years where roads could be dedicated as public but not maintained or owned by anyone. There are about 200 such non state maintained roads. The subdivision ordinance makes reference to only two types of roads, either a state maintained road or a private road with a right of way maintenance agreement. The 200 non state maintained roads are not address sf: The staff feels that there are several policy choices that can be made to handle further subdivisions on these 200 public non state maintained roads, The policies are: 1. Treat the roads as existing and require no additional improvements or agreements. 2. Require that the road be upgraded to State Department of Transportation standards from the existing State road through the far edge of the proposed subdivision. 3. Require that the road be upgraded to the appropriate private road standards from the state road through the proposed subdivision and a road maintenance right of way agreement be approved. 4. Require that the road be upgraded to the appropriate private road standards only across the frontage of the proposed subdivision The applicable private road would be determined by the number of lots that are using the road or the road constitutes the lots only access. The Planning Staff recommends that the 200 non state maintained public roads be treated as existing roads and the roads be upgraded to the appropriate private road standards across the entire frontage of the property being subdivided.
