Lucas Rezoning Request - Orange County Courtesy <br /> Review - Planning Board Recommendation to be forwarded to <br /> the Orange County Commissioners and Orange County Planning <br /> Board <br /> Date: February 17, 1981 <br /> REEKS": A request by Johnie D. Lucas to rezone approximately 4.37i. <br /> acres of land located at the southeast corner of the intersection <br /> of NC 86 and Weaver Dairy Road from the current Orange County <br /> Residential zoning designation to General Commercial zoning. The <br /> subject property is identified as Chapel Rill Township Tax Map 24, <br /> Lots 27 and 27B. <br /> DISCUSSION: The subject property is designated as high density <br /> iTaireET51 on the Chapel Hill Land Use Plan. The property, however, <br /> adjoins the Timberlyne Activity Center and could contribute to the <br /> viability of this activity center if the site were to be developed <br /> in harmony with the approved plans for Timberlyne. The Chanel Hill <br /> Planning Board believes that the subject property is at a very sensitive <br /> location, and the Board believes that the property should not be rezoned <br /> to General Commercial because if rezoned as requested there would be <br /> no opportunity for either staff or board review of the development <br /> plans either under the existing or proposed County zoning ordinances. <br /> The Chapel Hill Planning Board supports retaining the current resi- <br /> dential zoning since under the County's proposed zoning ordinance the <br /> applicant would be able to apply for the commercial or office use of <br /> the subject property under the Planned Development regulations. This <br /> process would allow the County to review the proposed development <br /> plans and adopt appropriate conditions. These conditions could <br /> address both the public safety and appearance concerns that are <br /> applicable to this site. <br /> This recommendation would require that the applicant wait until <br /> Orange County adopts its new zoning regulations. If such a delay <br /> was judged not to be acceptable, the County could transfer this <br /> property to the Town's Planning Area, as was done for the Timberlyne <br /> development. <br /> RECOMMENDATION: That the Chapel Hill Planning Board recommend that <br /> the proposed zoning map amendment be denied and that the current <br /> residential zoning be retained. Alternatively, that the Chapel Hil] <br /> Planning Board recommend that the property be transferred to the <br /> Town's Planning Area. <br />
