5.5 VARIANCE PROCEDURES <br /> (a) The Board of Adjustment as authorized by the Orange County I <br /> Commissioners shall hear and decide appeals and requests fox <br /> from the requirements of this ordinance. <br /> (b) The Board of Adjustment shall hear and decide appeals when i <br /> there is an error in any requirement,: decision, or determine <br /> by the building inspector in the enforcement or administrati, <br /> Ordinance. <br /> (c) Any person aggrieved by the decision of the Board of Adjustm( <br /> taxpayer may appeal such decision to the Orange County Superj <br /> as provided in Section l60A-388, f the North Carolina General <br /> (d) Variances may be issued for the reconstruction, rehabilitatio <br /> restoration of structures listed on the National Register of <br /> Places or the State of North Carolina Inventory of Historic P <br /> without regard to the procedures set forth in the remainder o: <br /> section. <br /> (e) In passing upon such applications, the Board of Adjustment shz <br /> consider all technical evaluations, all relevant factors; stall <br /> specified in other sections of this ordinance, and: <br /> (1) the danger that materials may be swept onto other lands t <br /> injury of others; <br /> (2) the danger to life and property due to flooding or erosioi <br /> (3) the susceptibility of the proposed facility and its contex <br /> flood damage and the effett of such damage on the individt <br /> (4) the importance of the services provided by the proposed fa <br /> to the community; <br /> (5) the necessity to the facility of a waterfront location, wh <br /> applicable; <br /> (6) the availability of alternative locations, not subject to <br /> . . <br />
