STATUTORY AUTHORIZATION, FINDINGS OF FACT, PURPOSE AND OBJECTIVES <br /> 1.1 STATUTORY AUTHORIZATION <br /> The Legislature of the State of North Carolina has in Section 110 of the Flood <br /> Disaster Protection Act of 1968 (Title XIII of the Housing and Urban Development <br /> Act of 1968 (Pub. L. 90-448), 42 U.S.C. 4001-4128, and 44 CFR Part 67.4(a) <br /> delegated the responsibility to local governmental units to adopt regulations <br /> designed to promote the b public health, safety, and general welfare of its <br /> citizenry. Therefore, the Board of County Commissioners of Orange County, North <br /> Carolina does ordain as-follows: <br /> 1.2 FINDINGS OF FACT <br /> • (a) The flood hazard areas of Orange_ County are subject) to periodic inundation <br /> which results in loss of life, property, health and safety hazards, <br /> disruption of commerce and governmental services, extraordinary public <br /> expenditures for flood protection add relief, and impairment of the <br /> tax base, all of which adversely affect the public health, safety and <br /> general welfare. <br /> (b) These flood losses are caused by the cnantlative effect of obstructions <br /> in flood plains causing increases in flood heights and velocities, and <br /> by the occupancy in flood hazard areas by uses vulnerable to floods or <br /> hazardous to other lands which are inadequately elevated, flood-proofed, <br /> or otherwise protected from flood darAges. <br /> • 1.3 STATEMENT OF PURPOSE <br /> It is the purpose of this ordinance to promote the public health, safety and <br /> general welfare and to minimize public and private losses due to flood <br /> conditions in specific areas by provisions designed to: <br /> (a) restrict or prohibit uses which are dangerous to health, safety and <br /> property due to water or erosion or in flood heights or velocities; <br /> (b) require that uses vulnerable to floods, including facilities which <br /> serve such uses, be protected against flood damage at the time of <br /> initial construction; <br /> (c) control the alteration of natural flood plains, stream channels, <br /> and natural protective barriers which are involved in the accomodation <br /> of flood waters; <br /> (d) control filling, grading, dredging and other development which may <br /> or flood damage; and", <br />
