Said <br /> facilities shall be constructed or ir,stalled so that, after <br /> construction or installation is complete, they shall cause .7. <br /> interference with proper use of said streets or roads, and lo <br /> interference with property rights of owners of property <br /> adjoining said streets or roads. In the event Village Cable <br /> of Orange County, Inc. shall fail to replace or repair any of <br /> the said public and private facilities within ten ( 10) working <br /> • days after written notice to do so from the Orange County <br /> • Manager, the same may be replaced or repaired by the proper <br /> authorities of Orange County, North Carolina, and the said <br /> • Village Cable of Orange County, Inc., in that event, shall <br /> forthwith pay to the County the cost of such work. <br /> Section V. Relocation of faCilities. <br /> In the event (at any time during the franchise period or any <br /> extension thereof) Orange County or the North Carolina <br /> Department of Transportation, by reason of traffic conditions, <br /> public safety, street closing, or abandonment, highway or <br /> street construction, change or establish any street grade, <br /> install sewers, drains, water pipes, power lines, signal <br /> lines, or any type of structure or improvement, Village Cable <br /> of Orange County, Inc. shall, at its expense, protect, <br /> support, temporarily disconnect, relocate in the same street <br /> - - or other place any of its properties, owned or leased, upon <br /> reasonable notice by the County or The North Carolina <br /> Department of Transportation. Neither the County nor The <br /> North Carolina Department of Transportation shall be liable <br /> for any disturbance of Village Cable of Orange County, Inc. 's <br /> installation resulting therefrom. Village Cable of Orange <br /> County, Inc. shall carry out instructions and directions of <br /> The North Carolina Department of Tranportation district <br /> engineer whenever it is necessary to raise or remove any of <br /> Village Cable of Orange County, Inc. 's wires or cables <br /> temporarily for the purpose of moving or removing structures <br /> -3- <br />
