Improvements <br /> OCO 8001 <br /> This memo concerns the difficulty we have encountered in getting a DOT <br /> encroachment signed for the Town of Hillsborough for the-installation o <br /> the water and sewer services in Northern Fairview. DOT requires that a <br /> encroachment contract be entered into by three parties: <br /> DepacLilent of Transportation - as the agency responsible. for the <br /> maintenance of the roads. <br /> Orange County as the agency making the installation. <br /> Town of Hillsborough - as the agency owning and operating the <br /> sewer system. <br /> Hillsborough -has objected to signing the agreement until Orange County <br /> provides a guarantee to cover the cost of all repairs that might become <br /> .necessary to the water and sewer service lines in the first year. Hill! <br /> borough claims they had a bad experience with the pinup station recently <br /> installed in Northern Fairveiw; for the first few months there were <br /> mechanical problems and the Town expended labor getting things correctec <br /> (the contractor warranted the parts) . The water and sewer serviCes <br /> now proposed will have a one-year contractor guaranteejparts and labor) <br /> but the Town wants fuller coverage, because they say that when a leak <br /> occurs there is not always time to call the contractor back- <br /> . <br /> As I see it, the County's options are as follows: <br /> 1. The County can appeal to the Hillsborough Commissioners to drop tb <br /> guarantee requirement because: <br /> a. there is a contractor's warranty, <br /> b. there is very little likelihood of repairs being needed in wat <br /> and .sewer service lines (almost all of which will not even be <br /> - . <br /> connected to) ,, <br /> c. Hillsborough is the agency collecting the water and sewer <br /> revenues, and thus they are the ones with the budget for repel <br /> In my experience no owner of a water or sewer system (such as a <br /> Town or owAsA) has ever required any guarantee beyond the contract, <br /> warranty of anyone making an addition to the water or sewer system <br /> (Does the Town make this requirement of a private individual who <br /> taps the water or sewer System?) <br />
