The Consultant shall comply with all of the - <br /> requirements ol f Title 21, U.S.A., Chapter 5, Subchapter 6, relating to fair <br /> - • employment practices to the extent applicable. A similar provision shall <br /> be included ir any and all Subcontracts. <br /> - - <br /> SECTION IX. NONDISCRIMINATION <br /> During the performance of this Contract, the Consultant, for itself, its <br /> assignees, and successors in interest agrees as follows: <br /> A. Compliance with Regulations • <br /> The ConstItant shall comply with the Regulations relative to nondis- <br /> criminationi in Federally-assisted programs of the U.S. Department of <br /> Transporttion (hereinafter, "USDOT"), Title 49, Code of Federal Regu- <br /> lations, 1" rt 21, and 23 CFR 710.405(b) as they may be amended from <br /> time to time (hereinafter referred to as the Regulations), which are <br /> herein incorporated by reference and made a part of this Contract. <br /> B. Nondiscrimination <br /> • The Consultant, with regard to the work performed by it during the Con- <br /> - tract, shall not discriminate on the grounds of race, color, sex, or <br /> national origin in the selection and retention of subcontractors, in- <br /> cluding procurements of materials and leases of equipment. The Consul- <br /> tant shall not participate either directly or indirectly in the dis- <br /> crimination prohibited by section 21.5 of the Regulations. <br /> C. Solicitations for Subcontracts, Including Procurements of Materials <br /> and Equipment <br /> In all solicitations either by competitive bidding or negotiation made <br /> by the consultant for work to be performed under a subcontract, includ- <br /> ing procurements of materials or leases of equipment, each potential <br /> subcontractor or supplier shall be notifed by the Consultant of the <br /> Consultant's obligations under this Contract and the Regulations rela- <br /> tive to non, discrimination on the grounds of race, color, sex, or na-. <br /> • tional origiln. <br /> • <br />
