METHOD OF PAYMENT <br /> The Consultant agrees to perform for the benefit of the client all services <br /> set forth and described in this contract on a cost plus. fixed fee basis in - • <br /> • .the amount not to exceed Nine Thousand Four Hundred Dollars ($9,400). <br /> • <br /> If the Consultant is requested to perform extra work, the Consultant shall <br /> promptly notify the Client that the work is beyond the level of effort <br /> required in the• contract. Examples of extra work include, but are not <br /> limited to, special or extra data collection; furnishing additional copies <br /> of reports; orl change in scope, character, or complexity of the study. -. • <br /> • <br /> The Consultant agrees to negotiate for extensions to this contract to <br /> encompass extra work or expansions of scope or effort that may be desired <br /> by the ClientJ, All changes in scope of services shall be included in sup- <br /> plemental agreements, which shall be executed prior to beginning of such <br /> supplemental work. The supplemental work agreements shall be approved by <br /> the Client, and NCDOT. <br /> The Consultant shall submit periodic invoices to the Client based on the <br /> • completion of tasks set forth in Attachment A to this contract. These - <br /> invoices shall be supported by a progress report. <br /> SECTION VI. TERMINATION FOR DEFAULT AND CONVENIENCE <br /> • <br /> A. Termination for Cost-Type Contracts <br /> The Client may terminate this Contract, or any portion of it, by serv- <br /> ing a notice of termination on the Consultant. The notice shall state <br /> whether the termination is for convenience of the Client or for default <br /> of the Consultant. If the termination is for default, the notice shall <br /> • state the knanner in which the Consultant has failed to perform the <br /> requiremenIts of the Contract. The Consultant shall account for any <br /> property n its possession paid for from funds received from the <br /> Client, or property supplied to the Consultant by the Client. The <br /> -Consultant shall promptly submit its termination claim to the Client <br /> and the parties shall negotiate the termination settlement to be paid <br /> the Consultant. <br /> • <br />
