R2 districts, where a land owner, developer or subdivider provides qualifying <br /> permanent open spaces as a part of a recorded subdivision containing lots for <br /> single-family detached dwellings, the lots within'such subdivision may have a <br /> minimum lot area and minimum lot width twenty percent(20%)less than herein <br /> otherwise required for the district or districts in which subdivision is located. <br /> _ Provided,however,in no case shall the total area of lot area reduction be more i <br /> __ than the total area of the qualifying permanent open spaces.Qualifying per?na- <br /> neat open space shall be land located within a subdivision at a location,size and <br /> shape as specifically approved by the Plan Commission and shall have an area <br /> of not less than four(4)acres or ten percent(l0%)•of the subdivision,exclusive- <br /> of street and alleys, whichever is the greater. Further, a qualifying permanent <br /> open space shall be a private recreation area where the ownership and mainte- <br /> nance responsibilities for such open space shall be assumed by the property <br /> owners with the necessary legal authority to discharge said responsibilities and <br /> where the use of such area for open space use shall be perpetuated by recorded <br /> covenants running with the land for the benefit of the owners within such subdivi- <br /> sion. <br /> "2.No use shall be established or hereafter maintained on a lot recorded after <br /> the effective date of this ordinance, which is of less area or less width than <br /> prescribed-herein for such use in the zoning district in which it is to be located. <br /> However,in the R5 and R6 districts,where the owner or owners of a zoning lot <br /> agree by a recorded covenant in favor of the City that the building coverage on <br /> a zoning lot shall not exceed 0.3,the lot area requirements for dwelling units and <br /> lodging rooms for the district in which such lot is located may be decreased by <br /> twenty percent(20%)." <br /> c 64 See Lexington, Ky.-Fayette County Zoning Ord. §§ 13.527, 13.522. <br /> Section 13.527, which pertains to useable open space and screening, states: <br /> (Zoning 1_1w, <br /> ~ <br /> ''...
