C. corporation, <br /> hereinafter called Owner; and the Town of Hillsborough, a municipal corporation <br /> •141 East Orange Street, Hillsborough, North Carolina 27278, hereinafter called <br /> • ;Town; . <br /> S E T H' <br /> ARTICLE I. General. Any pronoun need herein shall not be <br /> given a. <br /> literal construction if such interpretation would frustrate an otherwise clear <br /> { <br /> • intent when considered in the context in which used. • <br /> After this Easement/Agreement has been duly executed by each party in <br /> duplicate, the same shall be binding upon the parties hereto and their <br /> 'successors, in perpetuity;'otherwise, this document, and each and every clause <br /> and phrase thereof, shall be and remain null.and void. <br /> ARTICLE II. Easement: In consideration of the promise of the Town to <br /> permit the Owner to connect to the•Town system an extended water and/or <br /> sewer system to serve the property of the Owner; and in further consideration <br /> of the promise of the Town to maintain'said 'ir..s and apparatus from and after <br /> completion of construction and installation as hereinafter specified, the <br /> Owner does hereby give, grant, and.convey unto the Town, and its-successors <br /> and assigns, a perpetual right and easement over, upon and through the property <br /> or properties specified ai-Sc1s eda a •incorporated herein.to <br /> ntain'one or more underground water•and/or sewer lines and apparatus over, <br /> ;upon and through the lands of the Owner; •• <br /> Together with the'perpetual right and easement to go upon said lands <br /> } •enawer the same is reasonably necessary for the purpose of inspecting, <br /> 1•••intaining and repairing said lines and apparatus; provided, however, that in. <br /> repairing said lines, said Town shall remove all surplus earth, shall make <br /> • <br /> (level the surface of the ground above said lines and apparatus, and shall <br /> !intere£ere as little as is reasonably possible with any plants, fences, or <br /> other improvements upon the Sand of Owner. <br /> To have and to hold said rights and easements to the Town, and its <br /> successors, in perpetuity. <br /> ARTICLE III.
