Henry McDonald, and <br /> • my uncle, P. LI. McDonald, regarding their inability to secure an <br /> easement from the Poythress Family. The purpose of this letter is to <br /> relate to you heir efforts and reasons for requesting such an easement. <br /> In the summer f 1978, my uncle purchased 2.99 acres from Margaret Daniel, <br /> with the intenb of building a residential dwelling on said property and <br /> retiring in 1984. In October of 1984, my uncle came to Chapel Hill to <br /> begin making plans for his retirement home. It was at this time that he <br /> learned that he would not be able to get a building permit with the <br /> existing 12' easement over the Poythress property, which lies between his <br /> 2.99 acres and Damascus Church Road. Upon learning this, my uncle approached. <br /> Marvin PoythreSs and explained the situation to him, and requested an <br /> additional 50' easement, which was denied. <br /> Shortly thereafter, my father spoke with Mr. Poythress by phone and <br /> made the same request. Mr. Poythress responded that his attorney had <br /> advised him not to assent to"any additional easements. - <br /> Enclosed you will find a copy of a letter that I mailed to the Poythress <br /> brothers in an attempt to clarify the issue of the easement. At this <br /> writing they have not responded to this request for clarification. <br /> I would like te personally thank you and your staff for your assistance <br /> in our efforts to find an equitable -solution to this matter. <br /> Sincerely, <br /> A.0/1?-ei M:04,1,4( <br /> Susan C.
