115 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> NOVEMBER 19. 1985 <br /> ActionwAunda <br /> Item <br /> SUBJECT: PLANNED DEVELOPMENT REZONING EXTENSIONS <br /> DEPARTMENT: PLANNING PUBLIC HEARING Yes X No <br /> Attachment(s) Information Contact : SUSAN SMITH <br /> Telephone Numbers <br /> Hillsborough — 732-8181 <br /> Durham — 688-7331 <br /> Mebane — 227-2031 <br /> Chapel Hill — 968-4501 <br /> PURPOSE: To consider the extension of time Limits on (5) planned <br /> development amendments whose approvals have expired . <br /> NEED: Sections 7.2.8 and 7.9 of the Orange County Zoning Ordinance <br /> require that construction on property subject to planned <br /> development zoning amendments begins within six (6) months of <br /> Board action establishing a planned development district . <br /> Secti n 7.2.8 provides that "construction must start and <br /> proceled at a reasonable rate within six months of the approval <br /> of the permit . If no construction has started the permit <br /> becom!es null and of no effect . The owner can request a six <br /> month extension from the Board of County Commissioners if the <br /> reque6t is received before the permit expires . " Section 7.S <br /> provides that "if actions required in any amendment <br /> estab6shing a PO district are not taken within the time limit <br /> set, the Zoning Officer shall review the circumstances and <br /> recommend to the Planning Board and Board of <br /> County Commissioners : <br /> al that PD zoning for the entire area be continued with <br /> revised time limits; or <br /> b) that PD zoning be continued for part of the area , <br /> with or without revised time limits , and the <br /> remainder rezoned to an appropriate category; or <br /> c) that the entire district be rezoned from PD to an <br /> appropriate category ." <br />
