BOARD MINUTES 9-16-85 20 <br /> MOTION: Shanklin moved that the Board find that the <br /> applicant does comply with the general standards . <br /> Pearson seconded the motion . <br /> Yuhasz clarified that a "yes" vote on this matter <br /> would dictate that if the Land Use Plan amendment <br /> is approved, the planned development is <br /> appropriate. <br /> VOTE: In favor: Kramer, Pearson , Yuhasz, Shanklin <br /> Opposed: Best , Pilkey, Walters, Jacobs <br /> Abstention : Miller <br /> MOTION: Pearson moved that if the Planned Development is <br /> approved that the conditions as recommended by <br /> staff be attached . Shanklin seconded the motion . <br /> Yuhasz asked that staff explain 06 . Smith <br /> clarified it referred to a property description by <br /> plat . <br /> Pilkey expressed concern about the Location of the <br /> ponds in the railroad right—of—way, rather than on <br /> property the applicant owns .. Yuhasz clarified <br /> that Chandler owns the Land in the right—of-way. <br /> He added that he had raised the question regarding <br /> how close structures can be to the railroad at the <br /> public hearing. Pearson commented he could see no <br /> difference in the Location of the ponds in or out <br /> of the right—of—way. <br /> Jacobs suggested that a condition be attached <br /> requiring the ponds to be fenced to keep out <br /> children and animals . Yuhasz indicated this would <br /> restrict maintenance activity . Jacobs felt that a <br /> physical barrier is needed . Shanklin questioned <br /> the liklihood of children on the property . Best <br /> commented that he had seen 6 children , in three <br /> groups of two on Sunday on the property. <br /> The Board discussed fencing materials . Jacobs <br /> clarified that he desired "suitable" fencing to <br /> stop small children from accessing the ponds . <br /> MOTION AMENDMENT: Pearson amended the motion to include the <br /> condition that suitable fencing be installed <br /> around the holding ponds to prevent access by <br /> children and animals . <br /> Shanklin accepted the motion amendment . <br />
