1.1
0 1
Board of Commissioners Page Two. September 13, 1985
Question; Can the ordinance be written so that it
is clear that licenses obtained under it are not
transferable?
Yes. It is already implicit in the draft
ordinance that transferability is not permitted.
Making this point explicit is easily accomplished.
Question: Is it necessary for license applicants
to present fingerprints as part of the application
process?
We have determined that a positive identification
of a person with a criminal record can only be
determined through the State police information network
by the use of fingerprints. Furthermore, the
regulations and policies of the State of North Carolina
governing the use of the State police information
network for the purpose of local licensing requirements
require confirmation of a criminal conviction record by
the use of fingerprints. In other words, Orange County
could not use the State system for determining criminal
convictions without fingerprints of those being checked
if it intends to use the existence of a criminal
conviction as a basis for denying a license. The Board
therefore must require fingerprints if it wants to
condition licensing on the applicant having no
convictions of the crimes listed in the draft
ordinance. Alternatively, this requirement for
licensing can be removed in which case fingerprints
would be unnecessary. The change to the ordinance
detailed in the Manager's recommendation as new Section
1-4 (D) accomplishes, in the least intrusive manner we
could devise, the positive identification needs of the
licensing requirements.
Very truly yours,
40144.44
411110Mt- -(: ey E. ledhill
GEG/lsg
xc: Sheriff Pendergr. ss
Sylvia Price
Rick Rosen
Ken Thompson
