It is already implicit in the draft <br /> ordinance that transferability is not permitted. <br /> Making this point explicit is easily accomplished. <br /> Question: Is it necessary for license applicants <br /> to present fingerprints as part of the application <br /> process? <br /> We have determined that a positive identification <br /> of a person with a criminal record can only be <br /> determined through the State police information network <br /> by the use of fingerprints. Furthermore, the <br /> regulations and policies of the State of North Carolina <br /> governing the use of the State police information <br /> network for the purpose of local licensing requirements <br /> require confirmation of a criminal conviction record by <br /> the use of fingerprints. In other words, Orange County <br /> could not use the State system for determining criminal <br /> convictions without fingerprints of those being checked <br /> if it intends to use the existence of a criminal <br /> conviction as a basis for denying a license. The Board <br /> therefore must require fingerprints if it wants to <br /> condition licensing on the applicant having no <br /> convictions of the crimes listed in the draft <br /> ordinance. Alternatively, this requirement for <br /> licensing can be removed in which case fingerprints <br /> would be unnecessary.
