Collect by suit or otherwise such installment of rent or other <br /> sum as it becomes due or enforce by suit or otherwise any convenant <br /> or condition or term of this Lease required to be performed by <br /> Lessee. <br /> • <br /> 11. CONDEMNATION. If the Premises or any portion thereof are taken by <br /> any branch of government pursuant to the power of eminent domain, <br /> Lessor shall at its option, either equitably 'adjust the rent due <br /> hereunder or terminate this Lease. <br /> • <br /> 12. GENERAL PROVISIONS. <br /> 12.1 Severability. Any provision of this Lease determined to be <br /> ' i vn alid by a court of competent jurisdiction, shall in no way effect <br /> any other provisions hereof. <br /> 12.2 Interest' on Past Due Obligations.. Except as expressly herein <br /> otherwise provided, any amount due Lessor from Lessee not paid when <br /> due shall bear interest at eighteen (18%) percent per annum from <br /> the date due. Payment of such interest shall not excuse or cure <br /> any default by Lessee under this Lease. <br /> 12.3 Incorporation of Prior Agreements ; Amendments, This Lease <br /> contains all agreements of the parties with respect to any matter <br /> herein. No prior agreement or understanding pertaining to any such <br /> matter shall in any way bind the parties to this agreement. This <br /> Lease may be modified in writing only, signed by the parties in in- <br /> terest at the time of the modification. <br /> 12.4 Notices. All notices under this Lease shall be in writing and <br /> shall be deemed delivered twenty-four (24) hours after deposit in- <br /> the United States mail , postage prepaid, properly addressed to <br /> Lessee at the address of the Premises , or to. Lessor, at the address <br /> designated for rental payment. <br /> . 12.5 Waivers. No waivers by Lessor of any provision hereof shall <br /> be deemed a waiver of any other provision. <br /> 12.6 Holding Over. If Lessee remains in possession of the Premises <br /> or any part thereof after the expiration of the term hereof without <br /> executing a new lease, such occupancy shall be construed as a <br /> tenancy from month-to-month at a rental rate. in the amount. of twice <br /> the last monthly rental plus all other charges hereunder, and upon <br /> all of the terms of this Lease. <br /> 12.7 Binding Effect. Subject to any provisions hereof restricting <br /> assignment or subletting by Lessee, this Lease shall bind the part- <br /> ies , their successors and assigns. ' <br />
