OAKDALE PARK 42 PLANNED DEVELOPMENT/SPECIAL USE APPLICATION <br /> Collins presented for consideration a proposed Planned Development/Special <br /> Use Permit application for 52.78 acres of land located west of N.C. Highway 86 <br /> and east of the Interstate 40 corridor. The purpose of the request is to <br /> permit the construction of a 57 unit mobile home park. <br /> With reference to the negative finding in Section 7.14.3a7 Signs to be <br /> erected in accordance with Article 9. Collins indicated there was not a condi- <br /> tion that addressed this negative finding. <br /> Chair Willhoit noted the letter provided by Hillsborough which indicates <br /> the availability of water service is being modified to indicate an approximate <br /> date for providing such service but does not necessarily mean it will be <br /> available; it will be upon the action of the Tbwn Board. Be stated his concern <br /> is that this project is a tremendous distance from Hillsborough and does not <br /> provide for the orderly growth around the Sown of Hillsborough as provided for <br /> in the land use plan. Be feels it does not promote good public health, safety <br /> and welfare. Be suggested this item be tabled until such time that the Town <br /> can provide water to the development. <br /> Board Attorney Geoffrey Gledhill pointed out that the Board must make a <br /> finding on the evidence presented for the method and adequancy of the provision <br /> for sewage disposal facilities, solid waste and water service and determine if <br /> this part of the ordinance has been satisfied and met by the developer. <br /> Commissioner Marshall noted the problem is that this is not a transition <br /> area on the land use plan; that it is rural residential or rural buffer and our <br /> ordinance approves mobile homes. <br /> Commissioner Lloyd noted that this development has net the criteria of the <br /> ordinance and it would seem awkward to reject this development. <br /> Commissioner Marshall noted that the only evidence against this develop- <br /> ment was the concern of adjoining property owners about the devaluation of <br /> their property. <br /> Gledhill clarified that if the developer intends to lease spaces which are <br /> clearly defined on the ground then it is considered a subdivision. <br /> Collins recommended amending condition 414 to include that the final plans <br /> mast be approved within 6 months of the issuance of the special use permit and <br /> prior to the start of construction. <br /> Commissioner Marshall corrected #14 to read "prior to the issuance of the <br /> grading and building permit." <br /> Collins added to #11 the definition for hard surface and built to state <br /> standards. Also to 020 that signage details must be submitted to determine <br /> compliance with Article 9 signs prior to the issuance of signs. <br /> Motion was made by Commissioner Lloyd, seconded by Commissioner Walker to <br /> approve the development in accordance with the finding of fact subject to the <br /> 20 conditions as corrected by the Board. <br /> VOTE: AYES, 4; NOES, 1 (Chair Willhoit) <br /> 51 AMENDMENT TO THE ZONING ORDIKANCE-TEMPORARY MOBILE HOMES <br /> Collins explained this amendment allows for the use of a temporary mobile <br />
