053 <br /> AUGUST 20, 1985 <br /> REQUEST FOR AUTHORIZATION TO INITIATE LEGAL PROCEEDINGS <br /> 2 <br /> Upon notification of the requirement that they obtain <br /> building and zoning permits, the property owners <br /> were informed that the garage, where presently <br /> Located did not comply with the setback requirements <br /> of the Zoning Ordinance . The Flezzanis ' subsequent <br /> application fora variance of 13.8 feet from the 20 ' <br /> setback requirement was denied by the Board of <br /> Adjustment on August 6, 1984 (See Attached Minutes) . <br /> The Zoning Officer notified the Flezzanis of the <br /> denial of the variance request on August 7, 1984. To <br /> date, the Flezzanis have made no effort to correct <br /> the violation . <br /> B . PaLiourus Enterprise, Inc . <br /> AKA Workman 's Used Car Lot <br /> HILLSBOROUGH TWP . TAX MAP 45. (P/0) LOT 29 <br /> The lessee of the property upon which is Located <br /> Ray's E—Z Shop entered into an oral contract with <br /> Forest Workman for use of the southern portion of the <br /> property for a used car Lot (See Attached Map) . A <br /> utility building which serves as an office was <br /> erected on the site without building , zoning or <br /> electrical permits. The property is zoned CC-3 and <br /> subject to the requirements of the Major <br /> Transportation Corridor overlay zoning district . Use <br /> of the property for used car sales is not permitted <br /> in CC-3 district . Development within the MTC <br /> district is subject to submittal and approval of a <br /> site plan . <br /> The property owner, Paliourus Enterprise, Inc . , was <br /> notified of the zoning violation on July 17, 1985. A <br /> stop work order was posted on July 25, 1985. Mr. <br /> Workman was informed of the violations and remedies <br /> available to him on July 25, 1985. Mr. Workman 's <br /> attorney, W.A. Graham, was similarly informed on July <br /> 31 , 1985. <br /> The used car lot is still in operation with varying <br /> numbers of vehicles on site each day . <br /> IMPACT: Article 23 VIOLATIONS PENLTIES AND 'EMEDIES of the Orange <br /> County Zoning Ordinance provides that <br /> "whenever . . . the performance of any act is prohibited <br /> or whenever any regulation , dimension or Limitation is <br /> rwEssms...."01101 <br />
