STATE OF NORTH CAROLINA <br /> COUNTY OF ORANGE <br /> PLANNING SERVICES AGREEMENT <br /> BETWEEN <br /> THE COUNTY OF ORANGE AND THE TOWN OF HILLSBOROUGH <br /> TII_!,4ApREEMENT, made and entered into this day <br /> of 1985, by and between the COUNTY OF ORANGE, a <br /> poli;Zat subdivision of the State of North Carolina, hereinafter <br /> referred to as the "COUNTY" and the TOWN OF HILLSBOROUGH, a <br /> municipal corporation duly created and existing under the laws of <br /> North Carolina, hereinafter referred to as the "TOWN": <br /> WITNESSET H: <br /> WHEREAS the Town has previously employed an individual <br /> on a part—time basis for the purpose of providing planning <br /> assistance, issuing various permits and serving advisory boards <br /> and commissions; and <br /> WHEREAS the Town is presently without the services of such an <br /> individual and the Orange County Planning Department (hereinafter <br /> referred to as the DEPARTMENT) has need of additional staff in <br /> connection with its duties of administering land use regulations <br /> and preparing development plans and programs ; and <br /> WHEREAS the Department is currently enforcing the Orange <br /> County Subdivision Regulations and North Carolina State Building <br /> Code within •the corporate limits and extraterritorial <br /> jurisdiction of the Town ; and <br /> WHEREAS Chapter 160A, Article 20, of the General <br /> Statutes of the State of North Carolina permits one or more units <br /> of local government to enter into contracts or agreements with <br /> each other in order to execute any undertaking; and <br /> WHEREAS it is the desire of the County and the Town <br /> to enter into an agreement, one with the other, whereby both <br /> would be able to secure staff assistance in the provision of <br /> planning services; <br /> NOW, THEREFORE, in consideration of the premises and <br /> mutual terms and agreements hereinafter set forth, the County and <br /> the Town do hereby agree, each with the other, as follows: <br /> 1 . The County shall recruit and select an individual <br /> who shall be' responsible far the provision of such services as <br /> are set forth in this agreement and as may be otherwise agreed to <br /> by the Town and the Department. <br />
