Chandler responded they were in the <br /> vicinity. <br /> Pilkey asked if DEM knew they were in the railroad <br /> right—of—way. Chandler responded no , the Location was <br /> unclear at the time of DEM comment . He added that <br /> there was runoff before disturbance . <br /> Rhine indicated that DEM had not specified that the <br /> ponds go where they were installed according to a <br /> conversation her niece had had with DEM. The <br /> directive was to install facilities on the western <br /> part of the property . She noted that previously there <br /> was less noise and less of a view. Chandler <br /> noted that the Erosion Control Plan showing the ponds <br /> had been submitted and approved. <br /> Gordon stated that new information was available and <br /> that it could be recommended to the Board of <br /> Commissioners to go again to public hearing . <br /> Best inquired what the new information was . Gordon <br /> responded the whole issue of DEM regarding west side <br /> versus east side and runoff. Pearson noted that the <br /> west side is the whole side nearest the railroad. <br />
