• <br /> 15. Lessee's Remedy of specific performance. The <br /> agreement herein contained by Lessor to convey by general <br /> warranty deed the premises to Lessee on July 1, 1989 upon the <br /> payment by Lessee of the sum of $56,250.00 to Lessor and upon <br /> the satisfaction of all other terms and conditions of this <br /> lease/purchase contract shall be specifically enforceable by <br /> a court of law in the event Lessor refuses or is for some <br /> reason unwilling or unable to convey the premises to Lessee. <br /> 16. Nonappropriation of Funds. In the event no <br /> 5 <br /> funds or insufficient funds are appropriated and budgeted' or k <br /> are otherwise unavailable by any means whatsoever in any <br /> 5 fiscal period for ' lease payments due under this lease,. then <br /> .15 the Lessee will immediately notify Lessor of such occurrence <br /> • and this lease shall terminate on the last day of the fiscal <br /> • period for which appropriations were received and the lease <br /> payment was made. In the event of such termination, Lessee <br /> .11 <br /> • agrees to peaceably surrender possession of the premises to <br /> • Lessor on the date of such termination. Notices.
