20 <br /> The Department of Transportation requires that there <br /> be at least 2 occupied houses per tenth of a mile <br /> • (average along the length of the road) for a <br /> subdivision road to be eligible for State <br /> maintenance, if the road is brought up to State <br /> standards. The length of this road (including its <br /> proposed extension) is .366 miles. There are 8 <br /> existing homes served by Excel Lane or approximately <br /> 2 homes per 1/10 of a mile. <br /> Approval of a Class RA" private road (gravel) would <br /> result in subdivision of some of the lots. <br /> Planning Staff recommended approval of a minor <br /> subdivision to be served by a road dedicated public <br /> and constructed to State-maintained paved road <br /> standards. <br /> The Staff was requesting that the Board address the <br /> issue of the road only. A minor subdivision served <br /> by a Class A road (as required here by the number of <br /> lots served) must receive Board approval of the Class <br /> A road. <br /> Curtis Farrington informed the Board that the <br /> property would not be sold9 but was family land. <br /> Only 7 lots were currently being used. The purpose <br /> of the subdivision is to allow transfer of property <br /> to their children and the expense of upgrading the <br /> road is tremendous. He indicated he was acting as a <br /> spokesperson for the community. <br /> He continued that they would like the road to remain <br /> as it is, gravel with a 20' easement, and requested <br /> that the Board give a variance for that. <br /> Kizer responded variances cannot be granted to <br /> Subdivision Regulations. Smith clarified the Board <br /> could only allow a 25' partical width right-of-way of <br /> a full 50' easement. <br /> Yuhasz asked which lot is to be subdivided. Smith <br /> identified Curtis Farrington's lots but noted that <br /> other owners were interested in subdividing. <br /> Farrington responded he did not want or need to <br /> subdivide. <br /> Margison asked if the road allows for emergency <br /> vehicles access. Farrington responded yes. <br />
