14 <br /> PROPOSED SUBDIVISION REGULATIONS AMENDMENT <br /> ARTICLE VI REQUIRED MINIMUM DESIGN STANDARDS <br /> SECTION /V-B-3-C-2 P4RTIAL WIDTHS <br /> ISSUE: In the administration of the Subdivision <br /> Regulations, staff have recently encountered <br /> difficult and possibly irresolveable subdivision <br /> requests where the applicant cannot obtain even a <br /> partial width right-of-way of twenty-five (25' ) <br /> feet. This problem particularly arises in the case <br /> of lots created improperly by deed subsequent to <br /> the enforcement. of Subdivision Regulations to a <br /> given township and in the case of further <br /> subdivision of lots initially created by <br /> subdivision of tracts into 10+ acre lots and, <br /> thereby, exempt from the requirements of the <br /> Subdivision Regulations. Staff feels a means to <br /> provide a solution to those situations is needed. <br /> EXISTING ORDINANCE: • <br /> IV-B-3--c-2 Partial Widths - A partial width right- <br /> of-way, not less than 25 feet in width, may be <br /> dedicated when it adjoins undeveloped property; <br /> provided that the width of a partial dedication <br /> permits the installation of such public facilities <br /> necessary to serve the lots abutting therein. <br /> Where said adjoining undeveloped property is <br /> subdivided, the remainder of the full required <br /> right-of-way width shall be dedicated. <br /> PROPOSED SUBDIVISION REGULATIONS AMENDMENT: <br /> REVISE IV-B-3-c-2 to read : Partial Widths, - A <br /> partial width right-of-way may be allowed in a <br /> subdivision where: <br /> (a) In the judgement of the Planning Board and <br /> with the approval of the Board of County <br /> Commissioners, it is found that the nature and <br /> location of the subdivision, including such <br /> considerations as topography, the surrounding <br /> area, the present and future road plans, and <br /> access by public safety vehicles, are such <br /> that a partial width right-of-way is <br /> justified; and, <br /> (b) The access serving the subdivision is <br /> classified as either a Class B or Class C road <br /> according to the Orange County Private Road <br /> Standard; and, <br /> (c) The right-of-way width provided is adequate to <br /> allow for the construction of a travelway, <br /> ditches, shoulders and turn-around required <br /> for the class of road serving the subdivision; <br /> and, <br />
