00E <br /> (2) Requirement. To assure impartiality, the County Boarl <br /> of Commissioners will create a County Personnel <br /> • Commission, which among other areas of responsibility <br /> and authority that may be assigned, will hear and <br /> decide all appeals. The authority of the County Personnel <br /> Commission for effecting its decisions shall be in accord- <br /> ance with the provisions of (1) above. The membership of <br /> the Commission will consist of persons appointed by the <br /> Board of County Commissioners with due regard to its <br /> nature and purpose, with the stipulation that at least one <br /> member be chosen to represent the employees of the county. <br /> Such appointments will not include the county manager, <br /> county attorney, incumbent county commissioners, department <br /> heads, or their family members of relatives. <br /> (3) Requirement. The County Personnel Commission will have <br /> access in its meetings and deliberations, to the counsel <br /> • of a private attorney, not associated or engaged pro- <br /> fessionally in any transaction of the county. <br /> (4) Requirement. The County Personnel Commission will have <br /> The power to subpoena witnesses, principals, or other <br /> parties relevant to a fair and objective pursuit of an <br /> equitable decision. <br /> (5) Requirement. Proceddings before the Commission shall be <br /> recorded. At its discretion, the Commission may furnish <br /> a transcript of the recording or a copy of the recording <br /> upon request. Decisions of the Commission shall be in <br /> writing and maintained by the Commission. <br /> (6) Requirement. An impartial grievance procedure which has <br /> as its objective the timely and logical resolution of all <br /> grievances at the lowest practical point in the organization <br /> shall be established, with right of appeal assured at each <br /> step up to the County Personnel Commission. To the maximum <br /> extent possible, grievance procedures will include steps <br /> to resolve discrimination and all other types of employee <br /> grievances without recourse to the formal appeals process <br /> represented by the County Personnel Commission. <br /> Merit Principle V: Equal Employment Opportunity/Affirmative Action <br /> General Requirement.
