155 1 -� <br /> PROPOSED ZONING ORDINANCE TEXT AMENDMENT <br /> ARTICLE XI NON -- CQNFORMITIE$ SECTION 11.9c) <br /> ISSUE: In the administration of zoning/building permits <br /> during the last 4-5 years, the Planning Department <br /> staff has interpreted Section 11.9c of the Zoning <br /> Ordinance to allow for replacement of mobile homes <br /> where such a unit constitutes a second principal <br /> structure on one lot, unless the unit had been <br /> removed from the lot for a period greater than six <br /> months. <br /> The section of the ordinance which regulates the <br /> number of principal uses on a lot is Section 6.3.1 <br /> which states: It is the express- intent of this <br /> ordinance to regulate the number of principal <br /> structures constructed on each lot within Orange <br /> County. There shall be only one single family <br /> residence per lot . . . . A The staff <br /> interpretation that Section 11.9c) would apply to <br /> the replacement of mobile homes which violated <br /> Section 6.3.1 is incorrect. The Ordinance <br /> specifically addresses the replacement of non- <br /> conforming uses in Section 11.9d) . The only <br /> exception is Section 11.9d) which specifically <br /> addresses the replacement of mobile homes in a <br /> mobile home park. <br /> Staff is no longer issuing building/zoning permits <br /> for the replacement of these non-conforming mobile <br /> homes. However, staff would like to pursue <br /> amendment of the Ordinance to specifically allow <br /> this action. At issue is whether the intent of the <br /> non-conforming provisions to bring such situations <br /> into compliance with the Ordinance over time should <br /> be reconsidered given the nature of this housing <br /> type and the flexibility it provides in upgrading <br /> and/or replacement of such units. <br /> EXISTING ORDINANCE: <br /> 11.9 Non-Conforming Uses of )Major Structures, Or $truQt- <br /> urs and Premises in Combination <br /> Non-conforming use of structures with a value <br /> higher than in 11.8 above, or of such structures <br /> and premises in combination, may be continued, <br /> provided: <br />
