Farrington responded yes. <br /> Gordon asked if a limit on the number of lots could <br /> be set. Smith asked what number is appropriate. <br /> Yuhasz noted that at some point the road needs to be <br /> paved. <br /> Farrington asked why a variance could not be granted. <br /> Smith explained that the law does not allow variance <br /> to the Subdivision Regulations. <br /> Farrington asked why a public road was required. <br /> Smith responded because of the number of lots served. <br /> Farrington noted that this was family property. <br /> Smith responded that ownership could not be <br /> guaranteed over time. <br /> Walters noted most financial institutions require a <br /> 50' right-of-way for lending purposes. <br /> Gordon noted there was a question whether at issue <br /> was subdivision of Curtis Farrington's property or <br /> subdivision of all of the lots of record. <br /> MOTION: Kizer moved approval of a Class A road. <br /> Pilkey seconded the motion. <br /> VOTE: 8 in favor. <br /> 1 opposed (Gordon) . <br /> Kizer noted this decision on the road class was a <br /> compromise. <br />
