071 3 <br /> Yuhasz felt it was unfair to require paving of Rutoni <br /> Road if it was only going to serve 4 lots. The other <br /> two lots are to be served by Scott Road. <br /> Kizer noted that the applicant was only being asked <br /> to pave the road along his lot frontage. He further <br /> noted that Lot 43 was not served directly by this <br /> road and that the matter was complicated by the fact <br /> that there was another possible access to the general <br /> area. <br /> Yuhasz asked staff which class of private road that <br /> subdivision should meet. Staff responded a class A <br /> private road. <br /> • <br /> MOTION: Shanklin moved approval as requested by the <br /> applicant (with a class A ) . Seconded by <br /> Yuhasz. <br /> Kizer inquired what would happen if the 50 acres to <br /> Davis Road were developed. Kizer questioned who <br /> • should bear the burden of paving the road. <br /> ■ Yuhasz stated bOrie was premature and that the <br /> ,144.1041 <br /> developer of this subdivision could possibly, at the <br /> time of a later subdivision, contribute to the cost <br /> 04,410 of paving of the road. Yuhasz felt it was a terrible <br /> penalty to set a requirement for paving the road at <br /> this time. <br /> VOTE: In favor 3 - Yuhasz, Shanklin and Kramer. <br /> ] <br /> Opposed 7 <br /> .‘■':%;1) <br /> Motion failed. <br /> OPP. <br /> Noting the motion wash for approval, Gordon indicated <br /> that the preliminary plan would go forward to the <br /> Board of Commissioners with a recommendation for <br /> denial without a condition for paved road. <br /> The motion did not separate the specific issue of <br /> road standard from the overall issue of • <br /> approval/denial of the subdivision. Kizer felt that <br /> the purpose of justice had not been fulfilled in this <br /> matter. <br /> Gordon stated that the record would show that there <br /> was only one point at issue in the discussion of <br /> approval/denial of the subdivision, namely, the issue <br />
