Therefore, the Planning Board has no <br /> direct authority in the matter; the official appeal <br /> for a change of ruling of the interpretation of the <br /> Zoning Ordinance has to go to the Board of <br /> Adjustment. The outcome here tonight could not be <br /> any official action because the Planning Board has no <br /> decision making authority; however, in its capacity <br /> as advisors to the Board of Commissioners it could <br /> express our concerns. <br /> Representatives of Bingham TAC comments follow: <br /> Dan Eddleman, Member of Bingham TAC,' stated that the <br /> concerns of the TAC were expressed in the minutes of <br /> the TAC Minutes of March 21 and April 11, 1.985 page _ <br /> He noted there was new information <br /> regarding additional sites. <br /> Michael Hartley stated that he is not a member of the <br /> TAC, but is a resident in Bingham Township. He <br /> presented a map showing the locations of sludge <br /> application sites existing and proposed in Bingham <br /> Township (the map is attached on page of these <br /> minutes.) . OWASA is pursuing the utilization of <br /> lands in Bingham Township for the disposal of sewage <br /> sludge under a grant from Environmental Protection <br /> Agency and they have in the past used private <br /> farmlands, indicating that these materials were soil <br /> conditioners, nutrients of agricultural nature. <br /> These materials are also sewage materials sewage <br /> sludges as clearly identified in the permit from EPA <br /> which is a permit which applies to industrial waste <br /> and other waste. It makes no comment about these <br /> materials being agricultural in terms of the permit <br /> to discharge. In the summer of 1984, the conditions <br /> and. management of these programs became so offensive <br /> to the residents of area 4 of the map that a petition <br /> was circulated among the Clover Garden Church <br /> Community. 82 names were submitted to OWASA. <br /> The petition indicated that these materials were a <br /> nuisance and that they created runoff problems, <br /> terrible odors, attracted large swarms_ of flies, <br /> contaiminated wells. The petition was circulated in <br /> either late July or August. 1984. No public response <br /> was received from OWASA in the matter of this <br /> petition. Hartley noted that he had a copy of the <br /> petition if the Board wished to see a copy. Gordon <br /> stated that she would like a copy.
