011 <br /> 6 <br /> recognized by the State it needs more local <br /> attention. <br /> Gordon . stated that the problem seemed to revolve <br /> around the way bona fide farm is defined. The <br /> Planning Board could bring this to the official <br /> attention of the Hoard of County Commissioners only. <br /> The Board of County Commissioners could direct the <br /> County Attorney and staff to look into this further. <br /> Collins clarified that the letter he sent to OWASA <br /> contained certain conditions. As long as OWASA <br /> adhere to these conditions the use of that property <br /> would be considered a bona fide farm operation. <br /> These two condtions are as follows: <br /> (1) There must be a lease agreement or •some kind of <br /> contractural agreement between OWASA- and the bona <br /> fide farm operation.' <br /> (2) The farm operation on the OWASA owned land must <br /> be on extension of a bona fide farm. <br /> If either of these two conditions is not met, it <br /> changes the whole complexion of our position on this <br /> matter. It also changes the County Attorney's <br /> position. Also, if these conditions are not met, <br /> what we will proceed to do is regulate OWASA's use of <br /> the property through a Special Use Permit procedure. <br /> That is the only way at this time that we can see <br /> this as a bona fide farm operation. <br /> Gordon then asked if there were any new information. <br /> Hartley indicated that EPA has asked Orange County <br /> for comment. Gordon stated she had not seen such a <br /> document. Hartley added it was an April 9, 1985 EPA <br /> request for comment on findings regarding the Durham <br /> Heirs Tract. <br /> Collins noted this had not been received by the <br /> Planning Department. <br /> Hartley stated he would get a copy for Planning Board <br /> Chair. <br /> Gordon stated that she would like to hear from Mr. J. <br /> T. Thompson whose well had been contaminated. <br /> Mr. Thompson stated that his well had been <br /> contaminated three different times and it had to be <br /> pumped dry several times.
