This provision had been <br /> agreed to by both parties at earlier meetings; <br /> (2) The Town has discussed the issue of ownership of the lane and <br /> has agreed to forego any requirement that ownership of the line <br /> be transferred to the Town. <br /> (3) The Town request that a provision be included which would pro- <br /> vide that the County's tap fee would not be charged to users <br /> • in the Town's extraterritorial jurisdiction if and when such <br /> areas are annexed. Prior to any such annexation, the County's <br /> tap fee could be charged to users connecting to the County, <br /> • owned system. <br /> In conclusion, the only outstanding matter yet to be resolved is the <br /> third item listed above. We would appreciate the Commissioner's considera- <br /> tion of this one remaining item. <br /> Upon resolution of this remaining item we would be pleased to sign the <br /> proposed contract and forward it to you. <br /> • Sincerely, <br /> Frank H <br /> .
