0 2 E Nom CAROLINA <br /> ORANGE COUNTY <br /> AGREEMENT <br /> THIS AGREEMENT is entered into this day of <br /> 1985 and by and between the ("The <br /> Purchaser") and Orange County, a body politic and corporate ("The <br /> County"). <br /> WHEREAS, the County has developed a computerized system for <br /> use in the department of Orange County; and <br /> WHEREAS, the purchaser wants to use such a computerized <br /> system in its department under the circumstances <br /> set forth below; and <br /> NOW THEREFORE, in consideration of the premises and mutual <br /> promises set forth below, the parties agree as follows: <br /> 1. The purchaser shall pay the county the sum of one <br /> hundred dollars ($100.00). <br /> • <br /> 2. The County shall provide to the Purchaser the <br /> computerized system on a magnetic tape, along with complete <br /> loading instructions and a set of documentation needed to operate <br /> the system as it is currently used by the County. <br /> 3. Orange County makes no warranty as to the fitness for <br /> any particular purpose the software identified in this document <br /> other than that it is the software used by the County in the <br /> department listed above. In no event shall the County be liable <br /> for any loss, indirect, special, consequential or other similar <br /> damages arising from the inability of the software to perform. <br /> 4.
