Ordinance <br /> which would amend Section 2.3.7.2 to extend the time period <br /> within which an appeal for an interpretation of a determination <br /> by the Zoning Officer may be filed from fourteen (14) to thirty <br /> (30) days for approval. <br /> This item was ptesented to public hearing on November 26, 1984. <br /> NEED: Recently, an appeal was filed with the Board of Adjustment <br /> regarding the issuance of a building and zoning compliance <br /> permit to allow the expansion of a greenhouse.' The appeal <br /> pointed to the fact that the 14-day period within which an <br /> appeal must be filed was too short, given that little or no <br /> construction activity may occur within such a limited time <br /> frame. <br /> The N. C. State Building Code allows a 10-day appeal period to <br /> the Commissioner of Insurance or Department of Labor, or a 30- <br /> day appeal time if the appeal is to the Wading Code Council. <br /> IMPACT: The present Zoning Ordinance permits a 30-day appeal period (to <br /> the courts to appeal a decision by the Board of Adjudtment. <br /> Similar provisions are contained in both the Chapel Hill and <br /> Carrboro districts. Furthermore, both Chapel Hill and Carrboro <br /> ordinances allow a 30-day period to appeal the decision of the <br /> Zoning Officer. <br />
