2. Commitment of Public Funds. The City agrees that it will comnd t <br /> adequate local public funds for the local administration, of the 3 3 S <br /> Program. The City represents that it currently has the amount of <br /> local public funds unconditionally available for such commitment. <br /> 3. Performance. The City agrees to carry out its Rental <br /> Rehabilitation Program in accordance with the schedule in its <br /> Program Design as submitted to and approved by the NCHFA. <br /> 4. Tenant Assistance and Displacement. The City agrees to implement <br /> and operate their Program in accordance with their Tenant <br /> Assistance and Displacement Policy as submitted and approved by the <br /> NCHFA. <br /> 5. Affirmative Marketing. The City agrees to implement and operate <br /> their Program in accordance with their Affirmative Marketing Plan <br /> as submitted and approved by the NCHFA. <br /> 6. Agreements with Investor/Owner. The City agrees to enter into an <br /> agreement with each investor/owner receiving Program assistance <br /> which provides for recapture of the Program assistance should the <br /> investor/owner convert the assisted project to condominiums, <br /> discriminate against prospective tenants on the basis of their <br /> receipt of or eligibility for public rental assistance programs or <br /> discriminate against prospective or existing tenants on the basis <br /> of their having (or propose to have) a minor child or children <br /> living with them unless the assisted project is an elderly <br /> project. This Agreement will be liened against the assisted <br /> project. <br /> 7. Eligible Projects. The City may include a project in the Program <br /> if it meets all of the requirements of the Notice and any <br /> additional project eleigibility requirements as outlined in the <br /> City's Program Design. <br /> 8. Provision of Information. The City agrees to provide the NCHFA <br /> with any data, information or assistance that the NCHFA deems <br /> necessary to allow the NCHFA to monitor and evaluate the Program <br /> including, but not limited to, information regarding rehabilitation <br /> financing and any relocation of tenants occupying the building <br /> prior to rehabilitation and the specific relocation measures used <br /> in each case. <br /> 9. Notice to PHA. The City agrees to give the PHA days of <br /> notice of the actual need for issuance of section 8 Certificates or . <br /> Housing Touchers -for the City's Program or the maximum feasible <br /> notice possible. This notice will state the number of Section 8 <br /> Certificates and/or Housing Vouchers needed and the Bedroom sizes. <br /> 10. Administration of Section 8 Assistance. The PHA agrees to <br /> administer the Section 8 Existing Housing Certificate Program and <br /> Housing Voucher Program funding provided by HUD for the City's <br /> Program in accordance with: <br />
