F7 ' <br /> 67 <br /> 2.2 It is the policy of Orange County that any em- <br /> ployee may pursue resolution of a problem or <br /> grievance without fear of reprisal in accordance <br /> with this procedure. <br /> 2.3 Grievance involving alleged discriminatory actions <br /> may be handled in accordance with this procedure <br /> or as specified in the Equal Employment Opportuni- <br /> ty and Affirmative Action policies. <br /> 3.0 PROCEDURE <br /> 3. 1 STEP 1 <br /> The employee will first present his grievance <br /> verbally or in writing, to his immediate super- <br /> ' <br /> visor within 15 working days after the cause for <br /> the grievance occurred or became known to the <br /> employee. His immediate supervisor will then <br /> respond in writing to the employee within two (2) <br /> complete working days after the receipt of the <br /> grievance. The employee will sign a copy of the <br /> determination to acknowledge receipt and date of <br /> th response. The supervisor should and is encour- <br /> aged to consult with any County employee or offi- <br /> cer he deems necessary to reach a correct, impar- <br /> tial, and equitable determination concerning the <br /> grievance. If the employee is presenting a griev- <br /> ance concerning demotion, suspension or dismissal, <br /> he will present the grievance directly to the <br /> • Manager. <br /> 3.2 STEP 2 <br /> If the grievance is not settled in Step 1, the <br /> employee may appeal by contacting his department <br /> head within five (5) complete working days after <br /> receipt of the determination referred to in Step <br /> 1. Within two (2) complete working days, the <br /> department head will advise the employee in writ- <br /> ing of his determination. A copy wil be sent by <br /> the department head to the Manager, signed and <br /> dated by the employee to acknowledge receipt of <br /> • the response. <br /> 3.3 STEP 3 <br /> If the grievance is not settled in Step 2, the <br /> employee will appeal by giving written notice to <br /> the Manager within five (5) complete working days <br /> after receipt of the department head's determina- <br /> tion. Within two (2) complete working days, the <br /> Manager will advise the employee in writing of <br /> his determination. The employee will sign and <br /> date a copy of the Manager's response to acknowl- <br /> edge receipt thereof, or the Manager will make a <br /> notation in the employee' s folder that the em- <br /> ployee has been informed of the Manager' s re- <br /> sponse. <br /> The Manager' s decision will be final and there <br /> will be no action therefrom, except that an em- <br />
